1. ABOUT KENYA SCHOOL OF LAW
The Kenya School of Law is a training institution established under the Kenya School of Law Act, Chapter 16C of the Laws of Kenya. The mandate of the School includes undertaking practical training in law and related disciplines for the professional development of persons in the legal and related fields. The School is the agent of the Government for legal training and consultancies.
2. ABOUT THE COURSE
Prior to the promulgation of the Constitution of Kenya 2010, one of the most agitated issues was about the need to trim the powers of the president of the Republic. It was considered that the existing legal instruments vested in the president too much power, which often made the president to abuse the power by playing politics with it, e.g. allocation of land.
In 2010, during the discussion on the proposed new constitution, it was agreed almost unanimously, that there would be constitutional commissions to check the excesses of the Executive arm of Government. The idea of the commissions was to vest in them certain functions and powers to exercise them on behalf of the people, thus reduce the concentration of the powers in the presidency. There was the desire for the "fourth arm of government."
The Constitution therefore created twelve commissions and two independent offices. The composition and appointments are provided in the Constitution, as well as how the members thereof could be removed from office. Some of the measures taken were to provide for funding from the consolidated fund, fixed single term of tenure, among others.
Today, the question is whether the commissions have performed as expected, and if not, why? This course seeks to interrogate the conceptualization of the commissions, their structures, mandates, governance and delivery services in order to try to isolate the milestones and also challenges, 15 years after their creation.
3. INTENDED PARTICIPANTS
This course is highly recommended for the following participants:
a) Commissioners serving on these commissions, as well as staff working with commissions;
b) Constitutional law practitioners and scholars;
c) Political scientists;
d) Legal and other professionals;
e) Persons interested in law reform;
f) Scholars and practitioners on matters dealing with public governance, accountability and service delivery;
g) Non-governmental organizations dealing with constitutionalism, rule of law, and administration of justice;
h) Persons involved in implementing the constitution.
4. FACULTY
The School has assembled a highly experienced faculty comprising of seasoned practitioners on constitutional law, persons with experience in working with commissions, and teachers on constitutional issues to deliver during the workshop.
5. COURSE OBJECTIVES
By the end of the workshop, the participant should be able to:
a) Review the existing constitutional commissions for the period 2010-2025;
b) Evaluate the structure, functioning and service delivery of the constitutional commissions;
c) Describe the challenges facing the commissions today;
d) Identify remediable measures for effective execution of their mandates.
6. CERTIFICATION
Certificates of participation will be issued at the end of the training/workshop.
