COURSE OVERVIEW
The Public-Private Partnership framework sits within a country's overall strategy for social and economic development, being one of various means to procure and finance the provision of its infrastructure and services. As such, when planning and developing PPP infrastructure projects, the existing legal, regulatory and social environment of the country must be considered. A project agreement, no matter how well drafted, may be unenforceable and or irrelevant if it is inconsistent with the country's laws and regulations. The existing laws and regulations may prohibit or impede the proposed project and so the project may need to be adapted to fit within them.
It is in this context that the School has developed this practical one-week seminar focusing on:
- Overview of the PPP Legal and Regulatory framework in Kenya.
- Recent developments in Policy/ law impacting on PPP arrangements in Kenya.
- PPP life cycle and emerging best practice in PPP implementation in Kenya.
- Legal compliance and value for money audit of PPP projects
- Contract structuring, analysis and Practical steps to avoid legal challenges in PPP negotiations and contracting.
