ABOUT THE COURSE

In 2021, the School ran its inaugural Litigation Refresher Course for In–house Counsel. The Course had the objective of building the capacity of counsel working in State corporations to implement the advisory dated 6^th April 2017 by the Honourable the Attorney General of the Republic of Kenya that State corporations should use internal legal capacity in routine and non-complex matters or litigation, and particularly where a State corporation sues or is sued as a principal party and is not conflicted, or is sued or sues as a nominal party.

In the 2022 edition of the Course, the emphasis was on equipping in-house counsel or other counsel acting for an individual or corporate client with skills to effectively put across before a relevant forum their client’s case.

In 2023, the Course placed emphasis on equipping in-house counsel within State corporations, private corporations and counsel representing these corporations, with skills to effectively put across their client’s case in a digital litigation environment, from online filing, service on the digital platform, to online hearings and delivery of rulings and judgments on the digital platform.

Concerning the 2024 edition of the Course, concerns have been raised in Parliament (the Senate), on the high cost incurred by county governments in hiring external counsel as contrasted with relying on their internal legal capacity. The response to this has been that the county governments face obstacles in hiring lawyers with the skills they need.

This Course therefore is intended to equip participants with skills for effectively analysing the strong and weak points of their client’s case, properly capturing them in the pleadings and communicating them consistently through all stages of a case, including the pre-trial, the making of opening statements, hearing of the case by each side and in preparing and making the closing submissions, all for the benefit of the client.

INTENDED PARTICIPANTS

This Course is recommended for:

• County attorneys in county governments, attorneys serving in various county assemblies and lawyers working in the Senate, National Assembly and generally the Parliamentary Service Commission;

• Lawyers in the State Law Office and in State corporations in legal, supervision, compliance, investigation and enforcement departments and sections;

• Legal officers in private companies;

• Advocates in private practice who represent State agencies and private corporations from time to time;

• Any advocate interested in refreshing their skills in litigation

• Lawyers from the East Africa region and other Commonwealth countries in Africa.

COURSE CONTENT

The topics to be covered in the course will include:

·         Understanding the legal and regulatory framework establishing various client institutions as applied to litigation;

·          ADR for optimal conclusion and management of litigation;

·         Effective case management to achieve optimal resource use;

·         Areas of attention in Judicial Review, Constitutional Applications and Appeals;

·         Applying Trial Advocacy skills for best client representation.

INTENDED OUTCOMES

It is expected that at the end of the course a participant should be able to effectively handle all aspects of their client’s case basing on the legal and regulatory framework of their client’s establishment and operations.

TRAINERS

The School has assembled a team of experienced trainers including litigation lawyers both from private practice and from State agencies with over twenty years’ post-admission experience.

CERTIFICATION

A certificate will be issued to the participants who attend the entire course.

Fee: Kshs. 95,000/= (covers tuition, course materials, stationery, lunch and refreshments and is inclusive of taxes). Participants will be expected to make their own arrangements for travel and accommodation.
